In the service we collect the necessary information to provide the services of job offers and social publications, making a network of professionals open, public and transparent. 1. Right of Information
If the user decides to register with our service, the data strictly necessary for the achievement of the purposes and aims for which the website is intended will be requested.
Information the service receives from the user
It refers to the information that the user enters at the time of registration (necessary information) and all the information that he decides to share in the different functionalities of the platform (optional information).
Registration information
In order to use the beBee service, the user must register with his/her personal data, including name, surname, e-mail address, date of birth, contact telephone number, gender, location and professional sector.
Information shared by the user
The information also refers to all the interaction actions that the user performs in beBee, such as the contents he shares, his updates, photos or videos he uploads, comments on other users' contents, adding himself to affinity groups, following another user and using our tool to import contacts from the email address book.
Publication of user information
As this is a professional network where the user's profiles are public, so that they can be found in search engines by recruiters and with the intention of providing a coherent and complete service, most of the information that the user provides about himself is published: name, surname, photograph, work experience, city of residence, studies, courses and certifications obtained, affiliation to professional groups, languages spoken, professional skills, professional services offered, links to his profiles in other social networks or blogs, and network of contacts.
All this information may be publicly available and may be visible to and shared by all users of the service, and even those who are not. If the user does not want all or some of this information to be publicly displayed, he/she can cancel his/her account or contact the support service to be unsubscribed.
Indexing in public profile search engines
Although the service's profiles are always public, the user has the possibility to indicate that he or she does not wish to appear in Internet search engines (such as google or bing, for example). In that case, although the profile remains public, the service takes technical measures to indicate to search engines that they should not register or index that profile. However, it should be noted that search engines take time to update this information.
Private user data
The data provided by the user in the private section of the profile are not displayed in their public profile, so that they cannot be seen by other users of the network or the Internet. However, when a user applies to register for a job offer, this data is provided to the company offering the job, so that they can evaluate the application and contact the interested party. The data in the aforementioned section that is considered private is the following: Date of birth, e-mail, telephone, sex, salary, postal address, nationality, work permit, possession of driving licence, availability for travel and/or displacement, and CV attached to a file.
Use of user information
The information received from each user is used to offer the services and functionalities in the best possible way to all users, registered companies, partners and advertisers. The main service offered is to provide truly relevant and related content to each of its users, including the suggestions and advertisements posted on each wall, which is specifically targeted to those users who might be truly interested; this is achieved by knowing the gender, age, profession, geographical location, interest groups, among other data collected before and after registration.
With the user's information, the company can perform internal operations, such as data analysis, problem solving, research, development of new tools and improvement of the service and interface.
In no case does the service share information about its users without their consent through the reading of these policies and their formal acceptance of them. By accepting and agreeing to the conditions, the user grants permission for such purposes. The user's data is for the exclusive use of the service and is not shared with advertisers or external organizations.
As the only exception, in the event of a change in ownership or sale of part or all of beBee, users' information may be shared with a third party, who will be entitled to use such information in accordance with beBee's current policies and any future changes with prior notice and consent of the user.
User data is stored for a period of time necessary to provide the services and products we offer to users. Generally, the information associated with an active account is kept until the conclusion of the user's final discharge by deleting the account; data retention is only generated on certain types of data.
Services provided to users
The service is a web page for job searches by individuals and for the search of professionals by businesses, and at the same time it is a professional social network, which connects people who are related to their profession and/or areas of interest.
After the registration process, a whole series of services and tools are offered to the user based on affinity for a wide range of interests: job exchange, projects to participate in, leisure, training, technology, travel, motor, dating, e-commerce, etc., all through the online platform itself. Within the user's profile, the service offers the reception of relevant content according to the interests declared by the user at the time of registration and through their behaviour observed in their interactions within the site.
Thus, the service suggests all kinds of information and online services, job offers, training opportunities, networking, affinity beehives, projects to participate in, services, news, leisure activities and opportunities, tourism, etc. considered of interest to the user. To this end, users are required to truthfully and correctly fill out an electronic form and include their personal and professional information necessary for the functions and purposes described. The processing of user data is focused on the achievement of these purposes, always within the established regulatory framework.
The data provided by the user will be incorporated into a file registered with the Data Protection Agency, of which beBee Affinity Social Network S.L. is the holder.

The personal data of users is stored in a database owned by beBee, registered with the Data Protection Agency. The data collected is adequate, relevant and not excessive in relation to the scope, purposes and services determined, explicit and legitimate beBee. beBee has adopted the technical and organizational measures to ensure the security of personal data and avoid its alteration, loss, or unauthorized access, given the state of technology, the nature of the data stored and the risks to which they are exposed, all in accordance with the provisions of Royal Decree 994/1999 of 11 June and other control procedures for the security of information systems.
2. User Consent
By creating an account, the user gives his or her unequivocal and express consent to the processing of his or her personal data in accordance with the purposes and services provided, as well as, where applicable, the transfer of such data to third parties for the purpose of fulfilling the service (subject to the conditions specified in the privacy control section). For these purposes, the third party is understood to be "the entities that use the services of beBee". The users authorize beBee to access their personal data, regardless of their level of privacy, in order to inform them of specific job offers that fit their professional profile.
Electronic Communications Service
Alerts:
Automatic and free reception of jobs, services and other opportunities beBee will send, through electronic communications (email, browser messages and SMS), in a fast, personal and free way, all the necessary and interesting information that best suits the user, among others; Service emails (registration, password reminder, invitations, registration, etc.);
Keyword alerts;
Instant alerts according to geographic location, interests and group; Job bulletin according to province and categories; Training bulletin according to geographic location, interests and group.
beBee establishes two mechanisms by which users who request it can easily and freely exclude themselves from this service. To do so, the user must enter beBee, identify him/herself and go to the 'Private Menu' located on the upper right of his/her profile; click on the 'Alerts' or 'Notifications' section and deactivate the option to receive this service or configure each one as desired. You can also exclude yourself from the service by following the instructions at the bottom of the body of each email you receive from beBee.
Other communications
beBee will send registered users through communications (e-mail, sms, web, postal mail and mobile devices) news, promotions related to beBee, commercial offers and advertising from the recruitment sector, as well as from the music, television, cinema, radio, communication, training and education, hotel, financial, distribution, sports, travel, insurance, NGO, publishing, automotive, employment, real estate, weather, distance selling, energy, fashion, textile, video games, health, water sector, mass consumption, leisure, administration, electronic and telecommunications sectors. beBee sends the following electronic communications to users who have previously authorized it:
- beBee Newsletter: Tips on finding career opportunities, reports, trends, etc.
- Sector Newsletter: Information on employment in certain sectors.
- News: News about beBee and knowledge of its tools and purposes.
- Advertising: Promotion of third party products and services.
3. Content posted and shared by the user
Control of the contents:
Posts, comments, recommendations made by the user are always public, and are displayed next to the user's name and profile picture. This information can be seen by any other Internet user.
The user must take into account that all content made by a user account is the responsibility of the user who administers that account, and that all generated content becomes the property of beBee. Once the user terminates the account, all user-generated content is deleted. The user is solely responsible for the content he/she discloses in the service, as well as the images, videos or copyrighted content. beBee is not responsible for this content.
Content and information that a user shares about another user:
Tags and links. Any user of the service can include links and tags in their shares and updates. Links are understood to be any URL that leads to a website and can be both inside and outside of beBee.
A tag is a type of link generally used to mention another user. When a user tags another in a piece of content, the tag links to the profile of the named user. In case the user does not want to be tagged by someone else, it is advisable to contact that person directly and tell them about it. If the person still decides to tag, then the user can block the tag and cannot tag the user anymore.
Affinity Beehives or Groups:
Only the user himself can decide whether he belongs to an affinity hive or not, and it is he who decides when to leave it. When a user belongs to a beehive, all the contents within the beehive can be displayed on the user's wall. The user can be mentioned, tagged, linked or added to updates made by other members within the hive.
The user must take into account that all the contents he or she makes within a Beehive can be read and used by any Internet user; beBee is not responsible for the disclosure of information made within these forums or affinity beehives.
You can remove any buzz you have made in a beehive at any time, but you should be aware that other users may have copied all or part of the information that was once shared.
Search:
All users can search within beBee to find other users inside and outside their own hive (professional sector), or to find companies, affinity hives, job offers, keywords, etc.
Pages of companies and other institutions (universities, public figures, etc.) The pages of institutions such as companies, universities and other entities are public in beBee. All information published and shared through these will be visible for the creating user (member of the institution). All users who are followers of these pages will appear as followers of the page and can be seen by both the owner and other users.
Cookies and IPs:
The user accepts the use of cookies and IP tracking. Our site traffic analyzer uses cookies and IP tracking that allow us to collect data for statistical purposes: date of first visit, number of times visited, date of last visit, URL and domain from which it came, browser used and screen resolution. All the jobs contained in the search results of our service, or linked from those results, have been provided by external websites over which beBee has no control. beBee automatically indexes all jobs from external sources and assumes no responsibility for the content of any job listings.
Ads from crawling and indexing link activity on other websites are not subject to any prior control. With regard to the e-mailing activities of search posts, beBee does not carry out consulting activities for the searches of personnel of the companies, and its activities are limited to the collection and facilitation of the making available to the Users, of Advertisements published by Advertisers, informing them about new Advertisements referring to the job categories they have chosen. Therefore, the Advertiser is exclusively responsible for the content of the job offer. beBee does not participate in the negotiation between Advertisers and Users and does not carry out quality, security or legal controls on the job offers, nor on the veracity of the information that the Users send to the Advertisers.
5. Right of Revocation, Opposition, Access, Correction, Update and Cancellation of Data
The user has the right to access his/her personal data, to rectify them if the data is incorrect and to unsubscribe from beBee's services. Thus, the user can revoke his consent at any time for justified reasons, but no retroactive effects can be attributed. These rights can be enforced by the configuration of the website itself. 1. RECOGNITION AND ACCEPTANCE OF THE TERMS OF SERVICE
BEBEE AFFINITY SOCIAL NETWORK S.L. (formerly RED TRABAJAR S.L, hereinafter "BEBEE") a Spanish company with registered office at
beBee Affinity Social Network S.L.

and C.I.F B-84471838 is the owner of bebee.com and its apps. The BEBEE service is provided to the user (hereinafter "the USER") under the terms and conditions of this Terms and Conditions Agreement for the BEBEE service and in accordance with the operating rules and provisions published by BEBEE from time to time. This document constitutes the entire agreement between the USER and BEBEE and supersedes any prior agreements entered into by the parties with respect to the subject matter hereof. For the same purposes, beBee provides and shares the services it offers in the portal itself to the Iberempleos platform, a portal of job offers, projects, services, professionals and companies for Spain.
2. SERVICE DESCRIPTION
The BEBEE service is a web platform that allows USERS:
(1) connect with people related to their profession and/or interests,
(2) create, develop and maintain beehives of affinity,
(3) receive relevant content according to the interests declared by the USER,
(4) obtain suggestions and information about training, news, leisure activities and opportunities, tourism, among others, considered of interest to the USER,
(5) publish job offers, services and other professional opportunities
(6) add a CV to these job offers and professional opportunities, as well as sending proposals to the jobs and services advertised on the platform.
In this sense, BEBEE allows the USERS access to BEBEE's CV's according to the level of privacy selected by the USER. Likewise, the BEBEE service will be able to send the USER commercial communications through the existing means (e-mail, web, postal mail and mobile devices) both for employment, and/or other promotions or services related to financial and internet services, private sale, distance selling, fashion, training, mass consumption, state lotteries and bets, surveys, adsl, motor and others, with the previous express authorization of the user, which the user will have given when registering in the BEBEE service and accepting the present Terms and Conditions.
The USER must:
(1) have all the equipment, including a computer and a modem, necessary to establish the connection with the World Wide Web,
(2) have their own access to the World Wide Web and pay the telephone costs and/or those derived from another connection or service related to the mentioned access.
The USER agrees to the following:
(1) provide certain updated information, complete and accurate about the USER as requested by the Service, and for the fulfillment of the purposes of it, as set out in these Terms and Conditions, (2) maintain and update such information to keep it complete and accurate,
(3) acceptance of these terms and conditions authorizes BEBEE to use cookies and monitoring procedures of Ips, for the sole purpose of collecting data for statistical purposes such as: date of the first visit, number of times it has been visited, date of the last visit, URL and domain from which it comes, browser used and screen resolution. In any case, the user can delete these cookies by following the instructions of his Internet browser. The USER declares that he knows and is aware that the data he provides (hereinafter "Registration Information") will be incorporated into an automated file or personal data processing belonging to BEBEE and according to the provisions of Law 15/1999 of 13 December. The USER, in order to be able to be a user of the Employment service, will grant BEBEE, by means of the implementation of the registration form in BEBEE's Employment service, the right to give to third companies his condition of user of the Service, as well as all the Registration Information about the USER that would be necessary for the process of selection of the company, (by virtue of the characteristics outlined of the USER), for the contact with the USER by initiative of the company, by any viable means of communication, and for the final accomplishment of the hiring. If any information provided by the USER is false or inaccurate, BEBEE reserves the right to cancel the subscription of the USER and terminate the rights of the USER to use the Service. The USER authorizes BEBEE to keep and use the USER's data to offer him/her other services and products. The USER knows and is aware that the Registration Information is collected, recorded and kept by BEBEE in AWS (AMAZON WEB SERVICES ) and PROSODIE IBÉRICA, S.L.U. - CAPGEMINI . The USER may exercise his rights of access, rectification, cancellation and opposition with respect to the processing of his personal data on the website www.trabajo.org , depending on the origin of the user's registration on his respective website. The USER will be able to use different additional services catalogued as "PREMIUM" , which can be paid. The cost of this service is never refundable.
3. RIGHTS AND RESPONSIBILITIES OF THE CONTENT PUBLISHED BY THE USER
By posting content on beBee, you grant us a non-exclusive license to publish it on the beBee Services, including activities reasonably related to publishing (such as storage, display, reformatting and distribution). In consideration of beBee granting you access to and use of the Services, you agree that beBee may enable advertising on the Services, including the display of your content or other information. We may also use your content to promote beBee, including its products and content. We will never sell your content to third parties without your explicit permission. You are responsible for the content you post. This means that you assume all related risks, including reliance by others on its accuracy or claims relating to intellectual property or other legal rights. We invite you to publish content on beBee that has been published elsewhere, as long as you have the rights to do so. By posting content to beBee, you ensure that doing so does not conflict with any other agreement you have made. We may remove any content posted for any reason. You can remove any of your posts up to 30 minutes after they are posted. The removal process may take a little time, but we will do it as quickly as possible. We may keep backups of the deleted post or account on our servers for up to 30 days after removal.
4. CHANGES IN THE CONDITIONS OF SERVICE
Due to the special conditions of the service, and in order to provide the most appropriate service at all times, BEBEE may modify the terms and conditions of this agreement, notifying the USER by communicating the changes on the home screen, so that the USER is aware of them before proceeding to use BEBEE. The uninterrupted use of BEBEE by the USER will constitute a ratification of this document, with the modifications and changes that have been introduced.
5. CHANGES IN SERVICE
For the same reasons mentioned above, BEBEE reserves the right to modify or discontinue the BEBEE Service in whole or in part, with or without notice to the USER. BEBEE shall not be liable to the USER or any third party for the exercise of its right to modify or discontinue the BEBEE Service.
6. EXCLUSION OF LIABILITY
THE USER EXPRESSLY ACCEPTS TO ASSUME EXCLUSIVELY ALL RISKS ARISING FROM THE USE OF THE BEBEE SERVICE. THE BEBEE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. BEBEE DOES NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, TIMELY, OR ERROR-FREE, NOR DOES IT WARRANT THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE OR THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE SERVICE. NOR DOES IT GUARANTEE THE CORRECTION OF DEFECTS IN THE SERVICE. YOU UNDERSTAND AND AGREE THAT ANY MATERIAL AND/OR INFORMATION DOWNLOADED FROM THE SYSTEM OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL AND/OR INFORMATION. BEBEE DOES NOT GUARANTEE ANY OF THE GOODS OR SERVICES PURCHASED OR OBTAINED THROUGH THE SERVICE OR TRANSACTIONS MADE THROUGH THE SERVICE. NO RECOMMENDATION OR INFORMATION OBTAINED BY A USER, DIRECTLY FROM BEBEE OR THROUGH THE SERVICE, WHETHER ORAL OR WRITTEN, SHALL CONSTITUTE A WARRANTY BY BEBEE IF NOT EXPRESSLY ASSUMED HEREIN. THE COMPANIES THAT POST THEIR JOB OFFERS ON THE BEBEE SERVICE ARE SOLELY RESPONSIBLE FOR OBTAINING ANY TYPE OF AUTHORIZATION, PERMISSION OR LICENSE, IF NECESSARY FOR THE PUBLICATION OF ANY OF THEIR JOB OFFERS. IN THIS SENSE, THEY ARE THE ONLY ONES RESPONSIBLE FOR OBTAINING THE MANDATORY ADMINISTRATIVE AUTHORIZATIONS IN THE FIELD OF MIGRATION FOR THE JOB OFFERS RELATED TO COUNTRIES THAT ARE NOT MEMBERS OF THE EUROPEAN ECONOMIC SPACE AND/OR EUROPEAN UNION. ANY COMPANY THAT INSERTS A JOB OFFER THAT CONTRAVENES CURRENT LEGISLATION WILL ASSUME EXCLUSIVE RESPONSIBILITY FOR THE DAMAGES AND CONSEQUENCES DERIVED FROM THE SAME, EXEMPTING BEBEE FROM ANY RESPONSIBILITY.
7. LIMITATION OF RESPONSIBILITY
BEBEE SHALL NOT BE LIABLE FOR IMPOSSIBILITY OF USE, INTERRUPTION OF BUSINESS, OR DIRECT OR INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING LOST PROFITS) REGARDLESS OF HOW THE EVENT OCCURRED, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY, OR OTHERWISE, EVEN IF BEBEE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
8. PROHIBITION OF RESALE OR COMMERCIAL USE OF THE SERVICE
The use of the Service is personal to the USER only. The USER agrees not to assign or make any commercial use of the Service without the express consent of BEBEE.
9. USER BEHAVIOUR
The USER is solely responsible for the content of the transmissions through the Service. The use of the service by the USER is subject to local, provincial, regional, national and international laws and regulations.
The USER accepts:
(1) not to use the Service for illegal purposes, nor those prohibited herein;
(2) not to interfere with or disrupt the network systems connected to the Service;
(3) to abide by all regulations, provisions and procedures of the network systems connected to the Service;
(4) to protect and be solely responsible for the security of their passwords, to ensure the confidentiality of the data included in the BEBEE SERVICE.
The USER shall not impede the use of the BEBEE Service by another USER or the use of similar services by another entity. BEBEE MAY, IN ITS SOLE DISCRETION, TERMINATE THE BEBEE SERVICE IMMEDIATELY, IF THE USER'S CONDUCT IS NOT IN ACCORDANCE WITH THESE TERMS AND CONDITIONS.
10. COMPENSATION
The USER agrees to indemnify and hold harmless BEBEE, its subsidiaries, affiliates, officers and employees, from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of the use of the BEBEE Service by the USER, or the breach by the USER of this Agreement, as well as the infringement by the USER or another user of the BEBEE Service through the USER's computer, of the intellectual, industrial property or other rights of a natural or legal person.
11. TERMINATION OF THE RELATIONSHIP
Both the USER and BEBEE may terminate the Service at any time, without notice, with or without justification, and such decision will be effective immediately. BEBEE shall not be liable to the USER or to any third party for the termination of the BEBEE Service.
In case of disagreement of the USER with any of the terms and conditions of this agreement or any of its modifications, or in case of not being satisfied with the BEBEE Service, the only immediate recourse is:
(1) discontinue using the Service;
(2) cancel your subscription to the Service;
(3) notify BEBEE of the termination.
Upon termination of the Service, the USER's rights to use the BEBEE Service and software immediately cease.
12. NOTIFICATIONS
Any notice between the parties must be in writing and sent either by e-mail or by the postal system. BEBEE may transmit notices or messages through the Service in order to inform the USER about changes to this agreement, the BEBEE Service or other matters of importance. Such transmissions shall be considered as notifications to the USER.
13. PARTICIPATION IN ADVERTISING CAMPAIGNS
The USER will be able to maintain correspondence with the COMPANIES that insert their job offers in the BEBEE Service, or selection processes. Such correspondence or participation, including in its case any additional deliveries of goods and/or supply of services by the COMPANIES (and the payment for them), and any other terms, conditions, guarantees related to such correspondence will be established only between the USER and the COMPANIES. BEBEE does not assume any responsibility or obligation derived from such correspondence or participation.
14. PROPERTY RIGHTS OF THE CONTENT
The USER acknowledges that the content, including but not limited to, text, software, music, sound, photographs, video, illustrations and other material found either in the COMPANIES' offerings or in the e-mail messages distributed or in the information commercially produced and presented to the USER by the BEBEE Service ("Content")), by BEBEE or by BEBEE's suppliers, is protected by intellectual property rights, patents and trademarks, service marks, and other rights derived from intellectual or industrial property; therefore, the USER is empowered to use this Content in the manner expressly authorized by the BEBEE Service. The USER is prohibited from copying, reproducing, distributing or making creations based on this Content without the express authorization of the BEBEE Service. The USER agrees not to decompose or alter the software of the BEBEE Service for any reason, nor allow third parties to do so.
15. GENERAL TERMS
This agreement shall be governed by Spanish law, and the parties shall submit any dispute arising from this agreement to the Courts and Tribunals of Madrid (Spain). The USER will not assign any right or obligation derived from this agreement, unless there is express written consent from BEBEE. Any attempt to transfer the Agreement without the aforementioned consent will be null and void and without effect. Notwithstanding the foregoing, BEBEE shall be entitled to assign this Agreement with all of its rights and obligations whether by sale of the service, dissolution, spin-off, merger of companies or any other form of transfer. This agreement shall be binding and in effect between the parties and their respective representatives, heirs, administrators, successors and holders of authorized transfers, except as provided herein. If any provision or provisions of this agreement are found by a court of competent jurisdiction to be contrary to law, such provision or provisions shall be redrafted to reflect as closely as possible the intentions of the parties, while the other provisions shall remain in full force and effect. If any provision of this Agreement is held to be invalid or unenforceable, the valid or enforceable portion and the remaining provisions of the Agreement shall remain in full force and effect. Any waiver by either party of a claim (whether express or implied) for any breach of this Agreement shall not constitute a waiver of the right to claim for another or subsequent breach. No provision of the Agreement shall be waived by any act, omission or failure to act of a party or its representatives or employees, but by a signed written instrument expressly waiving such provision. The clause titles in this agreement are used solely for the convenience of the parties and have no legal or contractual significance.

1. RECOGNITION AND ACCEPTANCE OF THE CONDITIONS OF THE SELECTION CONTRACT
BEBEE AFFINITY SOCIAL NETWORK S.L. (from now on "BEBEE") a Spanish company with address in
beBee Affinity Social Network S.L.

and C.I.F. - B 84471838 is the owner of a Workers' Selection service, (from now on Selection).
The SELECTION AGREEMENT is provided to THE COMPANY under the terms and conditions of this SELECTION AGREEMENT and in accordance with the operating rules and provisions published periodically by BEBEE. This document is the complete contract between THE COMPANY and BEBEE and prevails over any previous contract signed by the parties in relation to the object of the present one.
2. OBJECT AND REGISTRATION IN THE SELECTION CONTRACT
The purpose of the collection and processing of the data provided by THE COMPANY in the SELECTION CONTRACT consists of the alliance between BEBEE and THE COMPANY so that THE COMPANY, through the insertion of offers and search of CV's in the BBDD owned by BEBEE, finds candidates who give their consent to BEBEE to transfer their personal data to THE COMPANY and who fit the profile sought by THE COMPANY.
The Selection service will be governed by the Terms and Conditions included in BEBEE. THE COMPANY, in order to register in the present SELECTION CONTRACT, will fill in the application form, will accept these TERMS AND CONDITIONS OF THE SELECTION CONTRACT, and in case of not being refused the entrance by BEBEE within fifteen days, (refusal for which BEBEE's exclusive criterion will be the legality, professionalism, security and sufficient credit for the provision of the service), will be able to proceed to use the BEBEE service.
3. TYPES OF SERVICE
Free:
All companies and businesses that register with BEBEE will be able to publish all the job offers they wish (limited to the criteria that BEBEE establishes at each moment and which will be published on the web) free of charge. However BEBEE reserves the right of admission or rejection to any company in the free model, whatever the reason.
In order to assure the quality of the offers, BEBEE can carry out a control and validation work of the offers. BEBEE reserves the right to modify or delete the content of the offers as long as they do not comply with or deteriorate the quality of the service as detailed in these Terms and Conditions.
In return for the free service, companies authorise the receipt of electronic communications and promotional information from themselves and from third parties.
Payment:
BEBEE will give the possibility to all companies to have a payment service through the PREMIUM services. These services will be limited to the criteria established by BEBEE at all times and will be published on the website.
By contracting a paying service THE COMPANY accepts the automatic monthly renewal of this service. However, BEBEE will give the possibility to THE COMPANY to unsubscribe from any paid service.

4. CHANGES TO THE CONDITIONS OF THE SELECTION CONTRACT
Due to the special conditions of the service, and in order to provide the most appropriate service at all times, BEBEE may modify the terms and conditions of this contract, notifying THE COMPANY by communicating the changes on the home screen, so that THE COMPANY is aware of them before proceeding to use BEBEE. The uninterrupted use of BEBEE by THE COMPANY shall constitute a ratification of this document, with the modifications and changes that have been introduced.
For the same reasons mentioned above, BEBEE reserves the right to interrupt the SELECTION AGREEMENT in whole or in part, whether or not the COMPANY has been notified. BEBEE will not be responsible before THE COMPANY nor before third parties for having exercised its right to modify or interrupt the SELECTION CONTRACT.
5. REMUNERATION FOR beBee
THE COMPANY will pay, within the deadlines and according to the rates stipulated in the SELECTION SERVICE, the amounts accrued for the services contracted.
6. EXCLUSION OF LIABILITY
THE COMPANY EXPRESSLY AGREES TO ASSUME EXCLUSIVELY ALL RISKS ARISING FROM THE ALLIANCE WHICH IS THE OBJECT OF THE CONTRACT. BEBEE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
BEBEE GUARANTEES THE VERACITY OF THE EXPRESS CONSENT OF THE SUBSCRIBERS TO PROVIDE THEIR PERSONAL DATA AND TO ALLOW THE TRANSFER OF SAID DATA TO COMPANIES THAT MAKE PERSONNEL SELECTIONS THROUGH THE SELECTION SERVICE, AND WILL RESPOND, EXONERATING THE COMPANY, FROM ANY CLAIMS THAT MAY ARISE FROM THE LACK OF VERACITY OR FROM FALSE OR FRAUDULENT CONSENT GIVEN BY THE SUBSCRIBER.
BEBEE DOES NOT WARRANT THAT THE CONTRACT WILL MEET THE COMPANY'S REQUIREMENTS OR THAT THE CONTRACT WILL BE UNINTERRUPTED, SECURE, TIMELY OR ERROR-FREE.
BEBEE EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF TITLE, FITNESS FOR SALE, SUITABILITY FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
THE COMPANY DECLARES THAT IT HAS UNDERSTOOD AND ACCEPTED THAT ANY MATERIAL AND/OR INFORMATION DOWNLOADED FROM THE SYSTEM PROVIDED BY BEBEE FOR THIS CONTRACT IS AT ITS OWN RISK AND THAT IT SHALL BE SOLELY RESPONSIBLE FOR ANY DAMAGE IT MAY CAUSE TO YOUR COMPUTER SYSTEM OR FOR ANY LOSS OF DATA CAUSED BY THE DOWNLOADING OF MATERIAL AND/OR INFORMATION.
BEBEE DOES NOT GUARANTEE ANY OF THE GOODS OR SERVICES ACQUIRED OR OBTAINED THROUGH THE SELECTION SERVICE BY ITS SUBSCRIBERS, NOR THE TRANSACTIONS CARRIED OUT THROUGH IT, IN PARTICULAR IT DOES NOT GUARANTEE THAT THE CANDIDATES OR USERS WHO OPTED FOR, AND/OR WERE FINALLY SELECTED BY THE COMPANY, TO COVER ANY JOB OFFER INSERTED IN THE BEBEE SERVICE, WOULD BE SUITABLE OR EFFECTIVE IN CARRYING OUT THE CORRESPONDING FUNCTIONS.
NO RECOMMENDATION OR INFORMATION OBTAINED BY ANY COMPANY, DIRECTLY OR INDIRECTLY FROM BEBEE, WHETHER ORAL OR WRITTEN, SHALL BE DEEMED TO CONSTITUTE A WARRANTY BY BEBEE UNLESS EXPRESSLY ASSUMED HEREIN
7. LIMITATION OF RESPONSIBILITY
BEBEE SHALL NOT BE LIABLE FOR ANY INABILITY TO USE, INTERRUPTION OF BUSINESS, OR DIRECT OR INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING LOST PROFITS, LOST PROFITS, OR MORAL DAMAGE ARISING FROM THE USE OF THE SERVICE BY CANDIDATES) REGARDLESS OF HOW THE EVENT OCCURRED, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY, OR OTHERWISE, EVEN IF BEBEE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
8. PROHIBITION OF RESALE OR COMMERCIAL USE OF THE SERVICE
The use of the Selection Service is personal to THE COMPANY only. THE COMPANY agrees not to assign or make any commercial use of the Recruitment Service without the express consent of BEBEE.
9. CONDITIONS OF USE and CONDUCT OF THE COMPANY
The works to be offered must offer legally valid contracts.
BEBEE is not responsible for the content of the offers:
(1) that require investment of money by the candidate.
(2) from "pyramid" companies or multi-level businesses.
(3) of business opportunities, (whether real or feigned), nor related to the adult entertainment industry or nightlife.
(4) Registration of minors without the custody of their parents or guardian.
(5) Susceptible to deception or involving any illegality in accordance with the applicable community framework.
(6) Discriminatory on the grounds of race, sex (according to Article 22 bis of Law 56/2003 on Equality, offers referring to one of the sexes shall be considered discriminatory, unless it is an essential professional requirement and a determining factor in the activity to be carried out), religion, opinion, nationality, disability or any other personal or social circumstance.
THE COMPANY shall be solely responsible for obtaining any type of authorisation, permit or licence, if necessary for the publication of any of its job offers.
BEBEE will not accept the insertion of offers not explicit, or that require a later contact by initiative of the candidate, with any motivation, already it supposes to the candidate an economic cost, (explicit or implicit), or not. BEBEE will not accept the insertion of duplicated offers, with contact data to request the initiative of contact of the candidate, (whatever the method of contact included), or that redirect to corporate employment sections, nor those offers that correspond to more than one position, (although THE COMPANY will be able to insert an offer for which it has more than one vacancy). THE COMPANY is solely responsible for the content of the transmissions it may make through the BEBEE Selection Service. The use of this service by THE COMPANY is subject to local, provincial, regional, national and international laws and regulations.
THE COMPANY accepts:
(1) not to use the aforementioned Service for illegal purposes, nor those prohibited herein;
(2) not to interfere with or disrupt the network systems connected to the Service;
(3) to abide by all regulations, provisions and procedures of the network systems connected to the Service.
(4) to give truthful information regarding the data required both in the registration of the company and in the insertion of offers;
(5) to keep all the information provided to BEBEE permanently updated and adapted at all times to the real situation of THE COMPANY;
(6) to be solely responsible for any false or inaccurate information made and the prejudices this causes to BEBEE or the users;
(7) the use of its name and image by BEBEE for any publication of an informative nature.
THE COMPANY will not hinder the access to the SELECTION AGREEMENT of another COMPANY or the use of similar services by another entity. BEBEE MAY, AT ITS OWN DISCRETION, TERMINATE THE SELECTION CONTRACT IMMEDIATELY, IF THE COMPANY'S CONDUCT IS NOT IN ACCORDANCE WITH THESE TERMS AND CONDITIONS. THE COMPANY may exercise the rights of access, rectification, cancellation and opposition, as well as to unsubscribe from BEBEE's services in the following way: through the very configuration of the web page, through the Companies menu or before the person responsible for the file. 10. SERVICE MANAGEMENT AND CV'S RECEIVED FROM THE COMPANY
THE COMPANY agrees to pay for any and all premium services contracted. BEBEE reserves the right to cancel any free service not paid by THE COMPANY at any time, without notice, with or without justification and for immediate effect. The services contracted by THE COMPANY shall have the duration stipulated in the contract.
11. INFORMATION AND GUARANTEES FOR THE PROTECTION OF PERSONAL DATA
By accepting this SELECTION AGREEMENT, the COMPANY expressly authorises the collection, recording and processing of its personal data for the strict purpose of complying with the terms of the SELECTION AGREEMENT. The data will be collected in a file of which BEBEE is the owner and responsible, which meets the requirements of Law 15/1999 on Protection of Personal Data, and development regulations. BEBEE declares that the data provided by the users who are candidates to the job offers, have been granted by means of express consent by the holders of the same ones, with the purpose of their treatment and/or cession to the contracting Companies of the BEBEE services, for the eventual reception of invitations to participate in selection processes and of the resulting job offers in their case. It will treat the Client's data to which it has access or which is transferred to it within the framework of this contract, in accordance with the provisions of the regulations in force.
In particular, it shall:
(1) access the candidates' data only in accordance with the purpose provided for in this contract;
(2) not disclose the personal data to persons other than those expressly authorised by this contract;
(3) protect the personal data to which it has access, applying the security measures contemplated in the regulations for the development of Law 15/1999, protecting its access codes to the BEBEE SERVICE, and not giving access to it to third parties. In this sense, BEBEE will give the COMPANY the possibility to eliminate the CV's received and discarded by it by means of a written, signed and sealed request from the COMPANY to

(4) inform BEBEE of any requests for cancellation, opposition, rectification and/or access that it may receive.
THE COMPANY knows and is aware that all the Registration Information is collected, recorded and kept by BEBEE, in its servers located in the facilities owned by AWS - AMAZON WEB SERVICES and PROSODIE IBÉRICA, S.L.U. 12. COMPENSATION
THE COMPANY agrees to indemnify and hold harmless BEBEE, its subsidiaries, affiliates, officers and employees, from any claim or demand, including reasonable attorneys' fees, made by any third party as a result of the use of the SELECTION AGREEMENT by THE COMPANY, or for the infringement by THE COMPANY of the provisions of this contract, as well as for the infringement by THE COMPANY or another user of the SELECTION CONTRACT through THE COMPANY's computer, of the intellectual, industrial property or any other right of a natural or legal person. In the same way THE COMPANY will indemnify and keep BEBEE free from any claim and/or sanction derived from the breach of the Organic Laws of Data Protection and Services of the Information Society and Electronic Commerce in the employment portals owned by BEBEE. To this effect, THE COMPANY declares that it will not make promotional deliveries of the SELECTION CONTRACT, to users or recipients who have not previously requested the sending of commercial information.
13. TERMINATION OF THE RELATIONSHIP
THE COMPANY as BEBEE may terminate the SELECTION AGREEMENT at any time, without notice, with or without justification, and such decision shall be effective immediately. BEBEE shall not be liable to THE COMPANY or to third parties for the termination of the CONTRACT. In case of disagreement of THE COMPANY with any of the terms and conditions of this contract or any of its modifications, or in case of not being satisfied with the SELECTION CONTRACT, the only immediate recourse is to notify BEBEE of the termination. At the moment of the termination of the Service, the rights of the COMPANY to use all the elements made available by BEBEE in application of the SELECTION CONTRACT cease immediately.
14. NOTIFICATIONS
Any notice between the parties must be in writing and sent by e-mail or by the postal system. Such transmissions shall be considered as notifications to THE COMPANY.
15. INTELLECTUAL PROPERTY
THE COMPANY acknowledges that the content, including but not limited to, text, software, music, sound, photographs, video, illustrations and other material found in either commercially produced information presented to THE COMPANY by BEBEE or by BEBEE's suppliers and/or advertisers and/or customers, (hereinafter "THE CONTENT")), is protected by intellectual property rights, patents and trademarks and registered trademarks, service marks, and other rights derived from intellectual or industrial property; therefore, the COMPANY is prohibited from using this Content in any way other than as provided in this AGREEMENT, and in a venue other than that of the BEBEE SERVICE. THE COMPANY is prohibited from copying, reproducing, distributing or making creations based on this Content without express authorization from BEBEE. THE COMPANY is obliged not to decompose or alter the software and/or elements provided by BEBEE for any reason, nor allow third parties to do so. Both BEBEE and THE COMPANY will keep all the rights over their respective names, logos, brands, and any intellectual property elements of any of them, not constituting any of the terms of the SELECTION AGREEMENT assignment or waiver of rights in any case. THE COMPANY will not create or distribute any material in which reference is made to BEBEE without the prior written consent of the latter.
16. GENERAL TERMS
This contract shall be governed by Spanish Law, and the parties shall submit any dispute arising from this contract to the Courts and Tribunals of Madrid (Spain). THE COMPANY will not cede any right or obligation derived from the present contract, except with the express written consent of BEBEE. Any attempt of cession of the Contract without the mentioned consent will be null and void. Notwithstanding the foregoing, BEBEE shall be entitled to assign this contract with all its rights and obligations whether by sale of the service, dissolution, spin-off, merger of companies or any other form of transfer. This contract will be of obligatory application and will have effect between the parties and their respective representatives, heirs, administrators, successors and holders of authorized transmissions, except for what is established here. If any provision or provisions of this contract are found by a competent court to be contrary to law, such provision or provisions shall be redrafted so as to reflect as closely as possible the intentions of the parties, while the other provisions shall remain in full force and effect. In the event that any provision of this Agreement shall be invalid or unenforceable, the valid or enforceable portion and the remaining provisions of the Agreement shall remain in full force and effect. Any waiver by either party of a claim (whether express or implied) for any breach of this SELECTION AGREEMENT shall not constitute a waiver of the right to claim for any other or subsequent breach. No provision of the Agreement shall be waived by any act, omission or failure to act of a party or its representatives or employees, but by a signed written instrument expressly waiving such provision. The clause titles in this contract are used solely for the convenience of the parties and have no legal or contractual significance.
